Monitoring in trial against Abdelkarim E.B.

On May 31, 2016, the Federal Public Prosecutor filed charges before the State Security Senate of the Higher Regional Court (OLG) Frankfurt am Main against Abdelkarim E.B., a 30-year-old German national. He was accused of joining the foreign terrorist organization "Islamic State of Iraq and the Levant" (ISIL/ISIG) (§ 129b para. 1 in conjunction with § 129a para. 1 StGB) and violating the War Weapons Control Act (§ 22a para. 1 no. 6 KrWaffKontrG). Additionally, he was charged with severely degrading and humiliating persons protected under international humanitarian law in connection with a non-international armed conflict (§ 8 para. 1 no. 9 VStGB, § 25 para. 2 StGB). The trial at the OLG began on August 22, 2016, and the verdict was delivered on November 8, 2016: Abdelkarim E.B. was sentenced to eight years and six months in prison for membership in a terrorist organization abroad in two cases, each combined with a violation of the War Weapons Control Act, and in one case combined with a war crime against persons.

On April 26, 2018, a further trial against Abdelkarim E.B. was opened before the OLG Frankfurt am Main, which was also observed by the Marburg Trial Monitoring participants. In this case, the accused was charged with membership in the foreign terrorist organization "Islamic State of Iraq and the Levant" (ISIL/ISIG) and the commission of a war crime against persons pursuant to § 8 para. 1 no. 3 VStGB.
